One Year Labor Warranty
- Scope of Coverage: This warranty applies to the installation of a new Coverstar pool cover mechanism purchased by a retail buyer for a residential pool.
- One Year Labor Warranty: Coverstar East Coast, Inc. warrants the installation of the Coverstar pool cover to be free of defects or malfunction for the period of one year from the date of installation. For a period of one year, Coverstar East Coast, Inc. will repair or replace defective parts without charge for labor. A charge for shipping, if necessary, is not covered and is the responsibility of the buyer.
- What is not covered: This limited warranty does not cover conditions caused by abuse, neglect, abnormal wear and tear, electrolysis or improper operation including your failure to comply with printed instructions or the operational video furnished with the cover system. Unreasonable use or failure to provide reasonable and necessary maintenance of the pool chemistry, fabric, rope, operating mechanism, and extrusions of the cover system are not covered. The cover pump is not covered by Coverstar, Inc. or Coverstar East Coast, Inc. but is warranted by the pump manufacturer according to its own warranty. All pump repairs are performed at an authorized service center listed in the pump instruction set. Coverstar East Coast, Inc. is not an authorized pump repair or service center. Maintenance procedures outlined in the Use and Care Guide such as maintaining proper water level and proper pool chemistry, cleaning the cover, flushing debris from the cover guides, maintaining adequate drainage for recessed housing systems, cleaning pulleys and other rotating surfaces, adjusting the torque limiter, patching the cover, and proper winterizing procedures are the buyers responsibility and are not warranted. Furthermore, labor to replace parts excluded from the manufacturers warranty such as rope pulleys, guide feeds and sliders which are considered consumed through use is not covered under the warranty.
- Governing Law: This Limited Warranty shall be governed by the laws of the state of Maryland without reference to conflicts of laws. All actions, claims or disputes arising under or relating to this Limited Warranty shall be brought and venued in the Frederick County District Court, in the state of Maryland. The parties irrevocably submit and consent to the exercise of subject matter jurisdiction and personal jurisdiction over each of the parties by such state district court. The parties hereby irrevocably waive any and all objections which any party may now or hereafter have to the exercise of personal and subject matter jurisdiction over such party by the above named state court, and to the laying of venue of any such suit, action or proceeding in such sate court in the state of Maryland.
